Welcome to Airefinery.
These Terms of Service (“Terms”) govern your access to and use of websites, applications, studios, commerce experiences, products, technology, AI-enabled tools, content, features and other services operated or provided by Airefinery Inc. (“Airefinery,” “we,” “us,” or “our”), collectively referred to as the “Services.”
Airefinery is building a modern platform across Style, Space and Living.
We bring together human creativity, artificial intelligence, design, commerce, manufacturing, materials, supply chain, craftsmanship and technology to transform ideas into products and experiences for individuals, creators and businesses.
Our Services may include:

Certain commerce functionality may be supported by Shopify or other technology providers.
By accessing the Services, creating an account, submitting an order, approving a custom project or otherwise using Airefinery, you agree to these Terms and any policies incorporated by reference.

If you do not agree to these Terms, do not use the Services.

1. Eligibility & Acceptance
You must have legal capacity to enter into a binding agreement in your jurisdiction to make purchases or enter contracts through Airefinery.
If you use the Services on behalf of a company, organization or other legal entity, you represent that you have authority to bind that entity.
By using the Services, you represent that:
— Information you provide is accurate
— Your use is lawful
— You have authority to make purchases using the payment method provided
— You will comply with these Terms and applicable laws
Electronic acceptance, checkout confirmations, electronic communications and electronic approvals may be used in connection with transactions through the Services.
2. Accounts
Certain Airefinery experiences may require an account.
You are responsible for:
— Maintaining accurate account information
— Protecting your password and credentials
— Maintaining the security of devices used to access your account
— Activity occurring through your account
— Promptly notifying us of suspected unauthorized access
You may not:
— Sell or transfer an account without authorization
— Impersonate another person
— Create accounts using false information
— Use accounts to commit fraud or abuse promotions
— Circumvent account restrictions
Airefinery may suspend, restrict or terminate an account where reasonably necessary to protect customers, our Services, our business or third parties.
3. Airefinery Across Style, Space & Living
Airefinery products and experiences may span several categories.

Terms specific to a particular product or category may appear on its product page, quotation, invoice, configuration page or agreement.
Those specific terms form part of your agreement with Airefinery.
3A. Creators, Brands, Suppliers & Product Integrations
Airefinery operates a flexible commerce ecosystem that may connect products and inventory from creators, designers, brands, manufacturers, distributors and other suppliers across Style, Space and Living.
Airefinery may source, integrate, list, sell or facilitate fulfillment of products through one or more methods, including:
— Direct commercial relationships
— Airefinery-operated systems and technology
— APIs and other system-to-system integrations
— Product, pricing and inventory feeds
— Approved distributors, manufacturers or fulfillment partners
— Third-party commerce applications and platforms
— Shopify Collective and similar services
— Managed or manual catalog onboarding where automated integration is not available
The integration or fulfillment method used may vary by product, creator, brand, supplier, territory, inventory source or customer location and may change over time.
Shopify Collective
Where Airefinery uses Shopify Collective, Airefinery may act as a retailer merchant and an independent connected brand or supplier may act as a supplier merchant within Shopify Collective.
Shopify Collective may enable participating merchants to connect product catalogs, inventory, pricing, orders, payments or fulfillment information through Shopify's technology.
Use of Shopify Collective or another third-party platform describes a technology or commercial connection and does not, by itself, create an employment, agency, franchise, partnership, joint venture, ownership, exclusivity or endorsement relationship between Airefinery and the applicable creator, brand or supplier.
Specific brands connected through Shopify Collective or other integrations may change from time to time and may be identified elsewhere in the Services.
Product & Inventory Synchronization
Airefinery uses commercially reasonable processes and technology to help keep product information, pricing, availability and inventory current.
Information displayed through the Services may originate from Airefinery or from creators, brands, suppliers, manufacturers, distributors or third-party systems and may be imported or synchronized automatically.
Because inventory and product information can change rapidly, synchronization delays, technical errors, supplier updates, overselling or other discrepancies may occasionally occur.
Displaying a product, price, inventory quantity or availability status does not guarantee that the product will remain available until the applicable order has been accepted and processed.
If a product becomes unavailable, is materially mispriced, contains a material listing error or cannot reasonably be fulfilled, Airefinery may, where legally permitted:
— Contact the customer for additional instructions
— Offer a substitute only with the customer's agreement
— Correct the applicable information for future transactions
— Cancel the affected item or order
— Refund amounts collected for a cancelled item
Supplier Fulfillment
Depending on the product, an order may be fulfilled by Airefinery or directly by a creator, brand, supplier, manufacturer, distributor, warehouse or other fulfillment partner.
Orders containing products from different sources may be divided into separate shipments and may arrive at different times or from different locations.
Unless Airefinery expressly states otherwise, customers purchasing through Airefinery should contact Airefinery Customer Experience regarding their Airefinery order. Airefinery may coordinate with the applicable supplier, brand, carrier or technology provider as reasonably necessary to investigate or resolve an issue.
Airefinery Standards & Supplier Review
Airefinery seeks to provide a high-quality customer experience and may evaluate products and supplier relationships using factors such as:
— Product quality and craftsmanship
— Product authenticity and integrity
— Accuracy and completeness of product information
— Inventory accuracy and availability
— Customer feedback, reviews and satisfaction
— Return, defect or damage trends
— Fulfillment performance
— Delivery reliability
— Responsiveness to customer issues
— Compliance and safety concerns
— Overall consistency with the Airefinery customer experience
Airefinery may add, limit, pause, suspend, discontinue or replace products, integrations or supplier relationships based on these or other commercially reasonable considerations.
Participation in Shopify Collective, another third-party platform or the Airefinery ecosystem does not guarantee continued product placement, availability or supplier participation.
Independent Brands & Suppliers
Unless expressly stated otherwise, third-party creators, brands and suppliers are independent businesses.
The appearance of a third-party product, brand name, trademark or supplier within the Services does not, by itself, mean that the third party owns, controls, sponsors or endorses Airefinery, or that Airefinery owns or controls that third party.
Nothing in this section reduces any responsibility Airefinery has to a customer under applicable law or any express commitment Airefinery makes in connection with a transaction.
4. Product Information
We seek to provide clear and accurate information about products.
Product listings may include:
— Materials
— Dimensions
— Size
— Fit
— Color
— Finish
— Construction
— Components
— Features
— Origin information where applicable
— Care instructions
— Manufacturing or processing timelines
— Customization options
— What is included with the purchase
Product information may be created or maintained by Airefinery or provided by a creator, brand, manufacturer, distributor, supplier or integrated third-party system.
Airefinery uses commercially reasonable efforts to present material product information accurately but does not warrant that third-party data will always be error-free, complete or synchronized in real time.
Customers are responsible for reviewing available product information before ordering.
If information important to your purchase is unclear, please contact Airefinery before completing the transaction.
Material errors brought to our attention will be addressed in accordance with these Terms, our applicable policies and applicable law.
5. Images & Product Representation
Airefinery may use several forms of visual presentation.
These may include:
— Product photography
— Studio photography
— Editorial photography
— Lifestyle imagery
— Computer-generated imagery
— 3D visualizations
— Renderings
— AI-assisted imagery
— Conceptual imagery
Product-focused imagery is intended to help represent the product being offered.
Editorial, lifestyle, staged, AI-generated or conceptual images may illustrate:
— Styling
— Context
— Mood
— Scale
— Possible configurations
— Design concepts
— Product environments
Unless expressly included in the product description, background elements, props, models, furniture, accessories or surrounding objects shown in an image are not included with a purchase.
Where a rendering or conceptual visualization is used for a custom project, the approved specifications, materials, dimensions and written project details govern the final product.
6. Natural Materials & Product Variation
Airefinery products may incorporate natural, handmade or specialized materials such as:
— Linen
— Silk
— Cotton
— Cashmere
— Leather
— Wood
— Stone
— Marble
— Metal
— Embroidery
— Hand-finished materials
Natural or handcrafted products may reasonably vary in:
— Texture
— Grain
— Veining
— Color tone
— Pattern placement
— Surface character
— Embroidery
— Finish
— Dimensions within reasonable manufacturing tolerances
Reasonable variations inherent in materials or craftsmanship are not necessarily product defects.
Displays, photography, lighting and screen settings may also cause colors and textures to appear somewhat different from the physical product.
7. Orders
Submitting an order constitutes an offer to purchase.
Receiving an automated acknowledgement does not necessarily mean the order has been finally accepted.
Airefinery may review an order before acceptance.
We may decline, limit or cancel an order for legitimate reasons including:
— Product unavailability
— Pricing errors
— Listing errors
— Technical errors
— Suspected fraud
— Payment issues
— Purchase-limit violations
— Shipping restrictions
— Compliance requirements
— Inability to fulfill the requested configuration
If Airefinery cancels an order after collecting payment and no product or service has been provided, the applicable amount will be refunded in accordance with law and our policies.
8. Pricing
Prices displayed through the Services may change.
Unless expressly stated otherwise, advertised product prices may not include:
— Applicable taxes
— Shipping
— Duties
— Customs charges
— Brokerage
— Installation
— Assembly
— White-glove delivery
— Special handling
— Custom engineering
— Custom design work
Any applicable amounts will be disclosed during checkout, through an invoice, quotation or otherwise before becoming contractually due where required.
9. Pricing Errors
Despite reasonable efforts, pricing or product information may occasionally contain errors.
If a material pricing error is discovered before fulfillment, Airefinery may:
— Contact you for approval of the corrected price; or
— Cancel the affected order and refund amounts collected for the cancelled item
Airefinery will not intentionally use pricing errors to mislead customers.
10. Payment
By submitting payment information, you represent that:
— The information provided is accurate
— You are authorized to use the payment method
— The payment may be charged for the transaction
Payments may be processed by third-party payment providers.
Airefinery may delay or cancel transactions reasonably identified as:
— Fraudulent
— Unauthorized
— High risk
— Subject to payment verification
— In violation of these Terms
For commercial or custom projects, different payment arrangements may apply, including:
— Deposits
— Milestone payments
— Production payments
— Final balances
— Commercial credit terms
These will be communicated separately.
11. Taxes, Customs & Duties
Customers are responsible for applicable taxes, duties, customs fees and governmental charges unless Airefinery expressly states that those amounts are included.
For international transactions, customs authorities may impose:
— Import duties
— VAT
— GST
— Brokerage charges
— Processing fees
— Other governmental assessments
Where Airefinery does not collect those amounts at checkout, they may be payable separately by the recipient.
12. Shipping & Delivery
Airefinery works with domestic and international logistics providers and may also use creators, brands, manufacturers, distributors, suppliers or other fulfillment partners to fulfill eligible orders.
A product may ship directly from Airefinery or from an applicable third-party fulfillment location. Orders containing products from multiple inventory sources may arrive in separate shipments, with separate tracking information and delivery dates.
Processing, production and shipping are separate stages.
Estimated delivery periods may depend on:
— Inventory availability
— Manufacturing
— Custom production
— Product configuration
— Shipping destination
— Carrier performance
— Customs
— Weather
— Holidays
— Force majeure events
— Other circumstances reasonably affecting fulfillment
Where required, tracking information will be provided when available.
Delivery estimates are estimates unless Airefinery expressly identifies a date as guaranteed.
Airefinery will comply with applicable requirements concerning shipping commitments, delays, cancellations and refunds.
13. Delivery Information
Customers are responsible for providing complete and accurate delivery information.
This includes, where relevant:
— Recipient name
— Address
— Unit number
— Postal code
— Telephone number
— Delivery access details
Additional expenses caused by incorrect information, refused delivery or failed delivery attempts may be charged to the customer where permitted.
For furniture or oversized products, the customer is responsible for confirming that the product can reasonably access the intended location through:
— Doors
— Hallways
— Elevators
— Stairways
— Loading areas
— Other access points
unless Airefinery has expressly agreed to verify access as part of the service.
14. Risk of Loss & Delivery Issues
Risk and title will transfer as provided by applicable law and the applicable transaction terms.
If an item is:
— Lost in transit
— Materially damaged in transit
— Delivered incorrectly
contact Airefinery promptly so we can investigate.
Customers should preserve packaging and provide requested evidence where reasonably necessary to process a carrier claim.
Nothing in this section limits non-waivable customer rights.
15. Returns & Refunds
Eligible standard products may generally be returned within 30 days of delivery, subject to the requirements in our Return & Refund Policy.
Returned standard products must generally be:
— Unused
— Unworn
— Unwashed
— Unaltered
— Complete
— In original condition
— Accompanied by original components and packaging where applicable
Certain products are excluded.
The complete Return & Refund Policy forms part of these Terms.
If there is a product-specific return condition disclosed before purchase, that condition may also apply.
The operational process for a return may vary depending on the product's inventory or fulfillment source. A return may be processed through Airefinery, an applicable supplier or an integrated returns or commerce platform.
Unless instructed otherwise, customers should initiate eligible returns through Airefinery. A supplier's internal policy does not reduce any rights expressly provided by Airefinery for the applicable transaction or any rights that cannot legally be waived or limited.
16. Custom & Made-to-Order Products
Custom products are fundamentally different from standard inventory.
Custom products may include:
— Made-to-order products
— Personalized products
— Customer-designed configurations
— Custom furniture
— Custom apparel
— Commercial fixtures
— Individually specified products
— AI-assisted customer designs
— Products produced specifically for a customer or project
Custom, personalized and made-to-order products are final sale and are not returnable, refundable or exchangeable once production commitments have begun, except where otherwise required by law or where the product is materially defective, damaged or materially inconsistent with the confirmed specifications.
17. Custom Order Cancellation
A custom order may only be cancelled before Airefinery or its partners have materially begun activities such as:
— Design work
— Engineering
— Sourcing
— Procurement
— Material reservation
— Fabrication
— Manufacturing
— Personalization
— Production
Once these activities have materially begun, the order may become:
Non-cancellable.
Non-returnable.
Non-refundable.
Any committed design, engineering, materials, manufacturing, procurement or production costs may become non-refundable where disclosed and legally permitted.
Custom project-specific terms may establish different cancellation milestones.
18. Customer Approval of Custom Designs
Some products require approval before production.
Approval may concern:
— Measurements
— Dimensions
— Renderings
— Drawings
— Materials
— Fabrics
— Colors
— Finishes
— Layouts
— Components
— Hardware
— Specifications
By approving a design or specification, you authorize Airefinery to proceed based on that approval.
Customers are responsible for carefully reviewing submitted specifications.
Changes requested after approval may result in:
— Additional charges
— Material changes
— Production delays
— Engineering changes
— New delivery estimates
A change in preference after approving a specification does not ordinarily constitute a product defect.
19. Artificial Intelligence
Airefinery may use artificial intelligence, machine learning and automated systems in connection with the Services.
AI-supported functionality may assist with:
— Product discovery
— Recommendations
— Styling
— Space concepts
— Visualization
— Design exploration
— Customer service
— Custom products
— Search
— Merchandising
— Manufacturing planning
— Supply chain planning
AI output can vary and may not always be complete, precise or appropriate for every purpose.
Customers should review material specifications, dimensions, configurations and custom project approvals before relying on an AI-generated recommendation or visualization.
AI-generated content is not a substitute for professional architectural, engineering, medical, legal, financial or other regulated professional advice.
20. Human Review & Design Judgment
Airefinery's vision combines human creativity with artificial intelligence.
AI-generated suggestions, renders, recommendations or concepts may therefore be:
— Reviewed
— Modified
— Refined
— Interpreted
— Replaced
by designers, manufacturing professionals or other qualified personnel.
For physical products, final approved specifications govern over preliminary AI concepts.
21. Connected & Technology-Enabled Products
Certain Airefinery products may incorporate:
— Software
— Sensors
— Connectivity
— Lighting
— Charging
— Digital interfaces
— Automation
— AI functionality
— Third-party integrations
Specific software, warranty, privacy, installation or connectivity terms may apply to these products.
Features may depend on:
— Internet access
— Compatible devices
— Third-party services
— Software updates
— Geographic availability
Airefinery does not guarantee continued availability of an external third-party service that it does not control.
22. Software Updates
Where relevant to a technology-enabled product, Airefinery or a technology provider may provide updates concerning:
— Security
— Performance
— Functionality
— Compatibility
— Reliability
Features may evolve over time.
Nothing in this provision permits Airefinery to remove rights or functionality where doing so would violate applicable law or an express contractual commitment.
23. Business, Trade & Commercial Customers
Airefinery may provide products and services to:
— Businesses
— Designers
— Architects
— Developers
— Hospitality operators
— Retailers
— Manufacturers
— Creators
— Commercial property operators
— Other professional customers
Business transactions may involve separate:
— Quotations
— Purchase orders
— Statements of work
— Specifications
— Commercial invoices
— Deposits
— Production agreements
— Delivery terms
— Installation requirements
— Manufacturing agreements
Where a separately executed written agreement conflicts with these general Terms, the separately executed agreement will govern that transaction to the extent of the conflict.
24. B2B Orders
Unless expressly agreed otherwise, commercial, wholesale, bulk, prototype and custom manufacturing orders may be:
— Final sale
— Subject to deposits
— Subject to production milestones
— Non-cancellable after manufacturing commitments
— Subject to specific inspection periods
Business customers are responsible for reviewing commercial specifications and approvals before authorizing production.
25. Creators & Designers
Airefinery may enable creators, designers, manufacturers and other professionals to collaborate through its platform or ecosystem.
Participation may be governed by separate agreements concerning:
— Intellectual property
— Commissions
— Revenue sharing
— Manufacturing
— Licensing
— Distribution
— Exclusivity
— Marketing rights
— Confidentiality
Nothing in these general Terms alone creates an employment, agency, partnership or joint venture relationship between Airefinery and a creator or independent business.
26. User Submissions
You may voluntarily provide materials including:

— Photographs
— Prompts
— Drawings
— Measurements
— Specifications
— Product ideas
— Reviews
— Feedback
— Files
— Other creative materials
You retain ownership of intellectual property you independently own in your original submission.
By submitting materials for Airefinery to process, you grant Airefinery a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, process and share those materials as reasonably necessary to:
— Provide the requested Service
— Evaluate your request
— Create designs
— Produce or customize products
— Coordinate manufacturing
— Fulfill your order
— Provide support
— Operate and improve relevant Services
Additional rights may be established by a specific creator, design or commercial agreement.
27. Responsibility for Submitted Content
By submitting content, you represent that:
— You have the right to provide it
— Its use for your requested purpose will not knowingly violate another person's rights
— The content is lawful
— The content does not contain malware or malicious code
— The information is reasonably accurate where accuracy is relevant
You may not ask Airefinery to manufacture or reproduce content that unlawfully infringes:
— Copyright
— Trademark
— Patent
— Design rights
— Privacy rights
— Publicity rights
— Other legally protected rights
Airefinery may decline a project where there are reasonable intellectual-property, legal, safety or reputational concerns.
28. Feedback
If you voluntarily provide general ideas, recommendations or feedback about Airefinery's products, platform or customer experience, Airefinery may use that feedback to improve its business without compensation or obligation unless separately agreed in writing.
This provision does not transfer ownership of a customer's independently owned proprietary design merely because it was submitted for a particular custom project.
29. Airefinery Intellectual Property
Except for user-owned or third-party materials, Airefinery and its licensors retain their rights in Airefinery intellectual property and proprietary assets.
This may include:
— Airefinery name
— Logos
— Trademarks
— Product names
— Product designs
— Original concepts
— Photography
— Renderings
— Videos
— Website content
— Software
— AI workflows
— User interfaces
— Platform designs
— Proprietary processes
— Commercial systems
— Manufacturing workflows
— Design systems
— Algorithms
— Data models
— Business methods
— Creative assets
Nothing in these Terms transfers Airefinery intellectual property to a customer except where expressly agreed in writing.
30. Permitted Use of the Services
Airefinery grants you a limited, non-exclusive, non-transferable and revocable right to access the Services for lawful personal or authorized business purposes.
You may not commercially exploit Airefinery Services or intellectual property except where expressly authorized.
31. Prohibited Uses
You may not:
— Violate applicable law
— Commit fraud
— Provide knowingly false information
— Infringe intellectual property
— Attempt unauthorized system access
— Introduce malware
— Circumvent security controls
— Interfere with Services
— Harvest personal information without authorization
— Abuse promotions
— Manipulate reviews
— Misrepresent your identity
— Engage in payment abuse
— Use Airefinery systems to harm another person
— Copy or commercially reproduce proprietary content without permission
Airefinery may investigate suspected violations and take appropriate action.
32. Automated Access, Bots & AI Agents
Automated systems, including:
— Bots
— Crawlers
— Scrapers
— Autonomous agents
— Automated purchasing systems
— Data extraction tools
may not access Airefinery Services in a manner that:
— Circumvents technical controls
— Creates unreasonable system load
— Extracts protected or proprietary information without authorization
— Violates applicable law
— Interferes with customers
— Attempts unauthorized transactions
Airefinery may separately authorize specific machine-to-machine or agent-based access.
Authorized automated access may be governed by separate API, developer or commercial terms.
33. Reviews & Community Content
If Airefinery permits ratings, reviews, comments or community content, you agree that submissions will be:
— Based on genuine experience where represented as such
— Lawful
— Non-deceptive
— Non-defamatory
— Free of malicious content
Airefinery may moderate or remove content that violates these Terms, subject to applicable law.
Providing a negative review alone is not a violation of these Terms.
34. Promotions & Credits
Promotions may be governed by separate conditions.
Unless stated otherwise:
— Promotions may have expiration dates
— Eligibility may vary
— Product exclusions may apply
— Offers may have minimum spending requirements
— Promotions may not be combined
— Promotional value is generally not redeemable for cash
— Promotions may be discontinued for future transactions
Airefinery may cancel or restrict benefits obtained through fraud, abuse or manipulation.
35. Gift Cards & Store Credit
Gift cards, store credit and promotional credits may be governed by separate conditions and applicable law.
Airefinery will not impose terms prohibited by applicable law.
36. Privacy
Our collection and use of personal information is governed by the Airefinery Privacy Policy.
That Policy explains, among other things:

The Privacy Policy is incorporated into these Terms by reference.
To process, fulfill, deliver, return, support or otherwise administer a transaction, Airefinery may provide information reasonably necessary for that purpose to applicable creators, brands, suppliers, manufacturers, distributors, fulfillment partners, carriers, payment providers and commerce technology providers, subject to our Privacy Policy and applicable law.
37. Third-Party Providers & Commerce Integrations
Airefinery may rely on third parties to provide, support, connect or fulfill aspects of the Services.
These may include:
— Shopify and Shopify Collective
— Creators, brands and suppliers
— Manufacturers and distributors
— Payment processors
— Cloud providers
— Logistics and fulfillment companies
— Installation partners
— AI providers
— Analytics providers
— Communications platforms
— Inventory, catalog, commerce and integration providers
Third-party services may be subject to their own terms, availability, technical requirements and operating conditions.
Airefinery may transmit or receive product, inventory, pricing, order, fulfillment, payment, return or related information through these systems where reasonably necessary to operate the Services or complete a transaction.
Airefinery does not control the independent operations of third parties and does not guarantee uninterrupted operation of a third-party platform, integration or supplier system.
Airefinery is not responsible for independent third-party conduct beyond the extent responsibility is imposed on Airefinery by applicable law, an express Airefinery commitment or contract.
Nothing in this section limits any non-waivable rights or remedies available to a customer under applicable law.
38. Third-Party Links
Airefinery Services may contain links to external websites.
A link does not necessarily mean Airefinery:
— Controls the site
— Endorses its content
— Guarantees its availability
— Accepts responsibility for its practices
Customers should review third-party terms and privacy policies before using those services.
39. Warranties
Specific Airefinery products may include an express written warranty.
Any express warranty will be described with the relevant product or documentation.
Except for express warranties and rights that cannot lawfully be excluded, Services and products are provided subject to applicable terms and conditions.
Airefinery does not warrant that:
— Digital Services will always operate without interruption
— Every feature will remain unchanged indefinitely
— Third-party systems will always remain available
— Every product will satisfy subjective preferences not contained in agreed specifications
Nothing in these Terms excludes warranties or consumer protections that cannot legally be waived.
40. Proper Product Use
Customers are responsible for using products:
— For their intended purpose
— Consistently with provided instructions
— Within reasonable weight or performance limits
— In appropriate environmental conditions
— With appropriate professional installation where required
Airefinery is not responsible, to the extent permitted by law, for damage caused by:
— Misuse
— Unauthorized modification
— Improper installation
— Failure to maintain the product
— Use outside stated specifications
— Customer or third-party alterations
41. Limitation of Liability
To the maximum extent permitted by applicable law, Airefinery and its officers, directors, employees and representatives will not be liable for indirect, incidental, special, punitive or consequential damages arising from use of the Services or products where such limitation is legally permissible.
This may include:
— Lost profits
— Lost business opportunity
— Business interruption
— Loss of data
— Indirect economic loss
To the maximum extent legally permitted, Airefinery's aggregate liability arising from a particular product or transaction will not exceed the amount actually paid to Airefinery for the product or service giving rise to the claim.
These limitations do not apply where prohibited by law and do not limit liability that legally cannot be excluded or limited.
42. Force Majeure
Airefinery will not be responsible for delay or failure caused by circumstances reasonably beyond its control, subject to applicable law.
Examples may include:
— Natural disasters
— Severe weather
— War
— Civil unrest
— Government actions
— Transportation disruptions
— Port closures
— Labor disruptions
— Major infrastructure outages
— Supply chain interruptions
— Epidemics or pandemics
— Cyber incidents not caused by Airefinery's failure to exercise legally required care
Where such an event materially affects an order, Airefinery will seek to communicate appropriate options consistent with applicable law and the transaction.
43. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify and hold Airefinery harmless from third-party claims arising directly from:
— Your unlawful use of the Services
— Your intentional violation of these Terms
— Content you submit without necessary rights
— Your infringement of third-party rights
— Your unauthorized modification or commercial exploitation of Airefinery Services
This section does not require a consumer to indemnify Airefinery for Airefinery's own unlawful conduct, negligence or obligations that cannot legally be transferred.
44. Suspension & Termination
Airefinery may restrict or terminate access where reasonably necessary because of:
— Material Terms violations
— Fraud
— Security risks
— Abuse
— Unauthorized access
— Illegal activity
— Threats to customers or systems
You may stop using the Services at any time.
Provisions reasonably intended to survive termination will remain effective, including provisions relating to:
— Payment
— Intellectual property
— Liability
— Confidentiality where applicable
— Disputes
45. Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles, except where mandatory law requires otherwise.
Mandatory consumer rights available to customers in their jurisdiction are not eliminated by this governing-law provision.
46. Informal Dispute Resolution
We believe most issues should be resolved directly and fairly.
Before commencing formal legal proceedings, you and Airefinery are encouraged to make a reasonable good-faith effort to resolve the matter directly.

Nothing in this section prevents either party from seeking urgent legal relief or exercising rights where a waiting period would be prohibited or inappropriate.
47. Venue
Unless applicable law gives a consumer a non-waivable right to bring a claim elsewhere, disputes arising under these Terms that proceed in court will be subject to the jurisdiction of appropriate state or federal courts serving King County, Washington.
Each party consents to jurisdiction in those courts to the extent legally permitted.
48. No Waiver
If Airefinery does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.
A waiver is effective only when expressly provided by an authorized representative.
49. Severability
If a court determines that part of these Terms is invalid or unenforceable, that provision will be enforced to the maximum lawful extent or severed where necessary.
The remaining provisions remain effective.
50. Assignment
Airefinery may assign these Terms as part of:

— Financing
— Merger
— Acquisition
— Sale of business or assets
— Reorganization
subject to applicable law.
You may not assign contractual rights or obligations under these Terms without Airefinery's written consent where those rights or obligations are personal to you.

— Order confirmations
— Approved specifications
— Commercial agreements
constitute the applicable agreement between you and Airefinery concerning the Services or transaction.
For a custom or commercial order, separately agreed written terms may supplement or supersede these general Terms.
52. Order of Precedence
If different Airefinery terms conflict, the following generally applies to the specific transaction:
